Dentons advises Stadler in connection with deliveries and approval of trains for PKP Intercity and Lodzka Kolej Aglomeracyjna

Dentons’ Public Procurement Team has advised Stadler – a leading rolling stock manufacturer – on the delivery of electric multiple unit trains to PKP Intercity. The carrier ordered 20 FLIRT3 sets for its long-distance lines. Dentons supported Stadler in the authorization proceedings before the President of the Office of Rail Transport for permission to operate all 20 trains. Under its contract with PKP Intercity, Stadler is required to provide maintenance services for the delivered trains over the next 15 years. This is one of the biggest investment projects in PKP Intercity’s history, worth a total of more than 1.6 billion PLN.

Dentons’ lawyers were also on hand during the successful authorization proceedings before the President of the Office of Rail Transport for permission to operate the 20 two-car FLIRT electric trains for Lodzka Kolej Aglomeracyjna (LKA) as compliant with all the applicable Technical Specifications for Interoperability (TSIs). This is the first approval of this kind issued in Poland for regional trains operated as part of a conventional railway system in Poland. Under its contract with LKA, Stadler provides maintenance services for its trains in a facility specially adapted for this purpose, with Dentons professionals advising the company on its contractual obligations.The project, one of the biggest in Poland’s regional railway market, is worth more than 510 million PLN

Lodzka Kolej Aglomeracyjna, a local government-owned railway undertaking, is a recent newcomer to the market which commenced its operations using rolling stock delivered by Stadler. Although it cannot boast a long track record, LKA has already won numerous accolades, including the “2015 Polish Innovation Prize”, “2014 Star of the Economy” award, a special prize at TRAKO (Poland’s largest railway fair), a prize in the “New Carriers” category awarded by the Polish railway magazine Rynek Kolejowy, and the “2014 Quality Certificate” in recognition of its superb quality control system, staff commitment and client satisfaction.

Dentons has been supporting Stadler in the execution of both ambitious projects since the tendering stage for the two contracts with the rail carriers.
