Allen & Overy advised Neoswiat PPP Projects, part of the French group Bouygues, on the development of Jagiellonian University student dormitories in a PPP deal.
This is the first PPP project in Poland involving a public university and also the first such venture in the public building sector.
The purpose of the project is to upgrade three existing dormitories and improve their adjacent sports and leisure facilities (car park, courts and pitches, catering establishments) for more than a thousand students. The project will be implemented as a PPP, where the private partner’s tasks are to design, convert and maintain the Badurskiego Street complex for 25 years. The UJCM will be responsible for the day-to-day management of the complex and obliged to pay remuneration (as an availability fee) to the private partner. The general contractor is Neoswiat PPP Projects (a Bouygues company), which will adapt the complex to the standards such facilities are expected to meet worldwide.
The Allen & Overy team was led by partner Tomasz Kawczynski supported by counsels Radomil Charzynski and Kamil Jankielewicz, senior associates Wojciech Pietrasiewicz and Olga Durawa, and associate Witold Bartodziej.
Tomasz Kawczynski commented: Signing the PPP Agreement with the Jagiellonian University Medical College is another milestone in the gradual opening of the Polish market to realising a variety of projects in the PPP structure. This is largely thanks to the changing attitude of the public sector towards partnership with the private sector. I am very proud that Allen & Overy had the opportunity to advise on this prestigious transaction, which reaffirms the firm’s strong position in the area of PPPs and, more broadly, project finance.
