Dentons has advised insolvent Berlin logistics company MyLorry GmbH on its sale to Takeaway.com. Operating under the brand Food Express, MyLorry employs 1,000 people and supplies more than 600 restaurants and caterers, as well as final customers. The buyer, Takeaway.com Group, is one of the world's largest online food ordering platforms and operates Lieferando.de in Germany.
The Berlin start-up company MyLorry, founded in 2013, filed for insolvency at the district court of Charlottenburg on 9 November 2015, as it could not cover costs after a period of intense growth, when turnover increased by up to 30 percent per month.
Takeaway will continue operations at all eight locations in Germany under the name Lieferando Express and take on the majority of the active drivers and management in order to continue expanding the business. Together with Directors Max von Waldenfels and Benjamin Pochhammer, the insolvency administrators have already initiated major operational restructuring measures at Food Express.
The Dentons team, under the leadership of Berlin Partners Dr. Rainer Markfort and Thomas Schubert, also advised the seller on all legal issues prior to insolvency.
