DLA Piper advises McDonald's on restaurant opening in Kyiv

DLA Piper has advised and represented McDonald’s, the leading global fast-service restaurant brand, in a recently completed transaction resulting in the opening of a new restaurant in Kyiv. McDonald’s used the development of residential complex Obolon Residences on the restaurant’s former plot where it had operated since 1999, as an opportunity to move to a new building with a brand-new format, unique architecture and innovated design. The new restaurant, with the area of over 750 square meters, McDrive line and a terrace, was opened on 8 November at 26A Obolonsky avenue, close to the location of the recently closed restaurant.

The DLA Piper Ukraine team provided full legal support to McDonald’s in the transaction, which included legal due diligence, advice on various construction regulatory, tax and land issues, structuring of the deal, development of transaction documents, negotiations with the developer and general contractor, assistance with title registration and closing of the deal.

The Kyiv-based Real Estate team was led by partner and Head of Real Estate in Ukraine Natalia Kochergina with key input from legal director Oleg Matiusha and associate Ievgen Storozhenko. Head of Tax Illya Sverdlov advised McDonald’s on tax related matters.

McDonald’s Head of legal Iryna Mysiychuk said: "It was a quite challenging deal with some complex legal and technical issues, which should have been resolved. This project was successfully carried out thanks to the involvement and support of DLA Piper’s legal team."
