Wierzbowski Eversheds Sutherland advises Nokia Solutions and Networks in successful tender for PKP PLK

Wierzbowski Eversheds Sutherland advised Nokia Solutions and Networks Sp. z o.o. in establishing a consortium for a tender procedure for PKP Polskie Linie Kolejowe SA concerning the construction of the ERTMS/GSM-R system on railway lines. The multi-billion-zloty project is one of the key modernization projects of the Polish railways and one of the largest projects of this type on the Polish market.

The subject of the tender was the design, delivery and execution of all necessary works and construction for the implementation of the GSM-R network on more than 13,000 km rail lines in Poland as a dedicated wireless digital communications system. The tender submitted by a consortium of the companies Nokia Solutions and Networks, SPC-1 (Wasko subsidiary), SPC-2 (Pozbud T&R subsidiary) and SPC-3 (Herkules subsidiary) was chosen as the best tender by the contracting entity on October 25, 2017. The net value is PLN 2.27 billion.

The advice for Nokia Solutions and Networks covered issues related to establishment of the consortium, negotiations and agreements with potential partners, and drafting of the tender. The client was advised by a team led by Tomasz Zalewski, with Julita Hoffmann, Anna Ochocka, Natalia Burchardt and Monika Zuzaniuk.
